No.
That’s why we have so many stupid “protect us from ourselves” laws.
Person does something risky, but reasonable. Said person gets hurt. Said person takes lawmaking jurisdiction to court for letting them engage in a potentially risky activity. For some reason the injured party wins. Lawmaking jurisdiction bans said activity to ensure they don’t get sued again.

NHTSA can’t be held responsible for that. Even if they could be hat would get them nowhere. NHTSA does no wrong remember? Approving Chrysler to add trailer hitches to fix the fire problem? Surely can’t blame NHTSA, that’s all Chryslers wrongdoing.

They bought the car either knowing it's safety rating or not knowing. Either way that's their fault. I'm not going to go sue Ford because my 1993 F150 has inadequate protection, I know that and willingly bought it.

Who decides if it's unsafe though? How fast was the truck going when it hit them? No matter how safe a car is, if you're rear ended by a pickup at say 40mph (who knows, speculation on my part here) the outcome isn't going to be pretty. Nissan made what they felt was a reasonably safe automobile. They can't control what idiots do behind the wheel.
